Background

The laws of the Falkland Islands are not easily accessible to users.

To address this, the Falkland Islands Government's strategic "Islands Plan 2014-2018" provides that it will produce and maintain an authoritative statement of Falkland Islands legislation that will be freely and publicly accessible.

A new Law Commissioner was appointed in June 2015 to lead the project to give effect to the Government's aim.

Timing

The project was expected to last up to two years.  Publication of the laws, through a statute law database, is now anticipated in July 2017

Project Plans

Detailed project plans were considered and largely approved by the Falkland Islands Government’s Executive Council on 23 September 2015.

The Council took longer to consider proposals for the process of continuing to update the application of United Kingdom laws to the Falkland Islands after the laws are published on-line in 2017.  Modified proposals were agreed in September 2016. Click here for a copy of the Executive Council paper.

Project Work Streams

What law will we publish?

Identifying the laws for publication has involved:

(a) preparing a full, up to date, statement of local laws; and

(b) compiling lists of the United Kingdom laws which apply in the Falkland Islands.

This work was carried out by the Law Commissioner with help from the legislative drafting team in the Law and Regulation Directorate.  The work was completed by May 2017.

Because the Falkland Islands relies on United Kingdom law which is no longer in force in the United Kingdom, recommendations were also made to the Legislative Assembly about bringing those laws up to date. This work was completed through the passing of the Law Revision and Publication Bill on 2 June 2017.  The Bill will be commenced simultaneously with publication of the statute law database.

The work preparing the law for publication was subject to various public consultations.

How will we publish the law?

A public procurement process was carried out for the technical solution for publication of the laws. An invitation to tender for the technical solution was issued in March 2016, and a contract concluded with Leidos Pty Ltd (of Australia) in December 2016. 

The contract provided for the design, creation, and publication of an on-line statute law database.
